Foryn User Agreement and End User License Agreement

1. Parties and Scope

This Agreement is between you and Foryn ("Foryn," "we," "us," or "our"), not Apple. Foryn is solely responsible for the Foryn mobile application, related websites, user-generated content features, support services, paid features, and any other services that link to this Agreement (collectively, the "Service"), except as otherwise stated in this Agreement or required by applicable law.

This Agreement includes an end user license agreement ("EULA") for the Foryn app. It applies to all users, including visitors, registered users, purchasers, subscribers, and users who submit, view, report, or interact with User Content.

Our Privacy Policy explains how we collect, use, and protect information. By using the Service, you acknowledge the Foryn Privacy Policy.

2. Eligibility and Account Responsibility

• You must be at least 18 years old to use Foryn.
• You must provide accurate information and keep it updated.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs through your account, except to the extent caused by our breach of this Agreement or applicable law.
• You may not create an account for another person without authorization.
• You may not use Foryn if we previously suspended or terminated your account for safety, legal, policy, or abuse reasons, unless we give written permission.

3. License to Use the App

Subject to your compliance with this Agreement, Foryn grants you a limited, personal, revocable, non-exclusive, non-transferable license to download, install, and use the Foryn app on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable App Store usage rules. This license is for personal, lawful use only.

The app is licensed, not sold. Foryn and its licensors retain all rights, title, and interest in and to the app, Service, software, design, text, graphics, logos, features, trademarks, and other materials, except for rights expressly granted in this Agreement.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, attempt to derive source code from, or create derivative works based on the app or Service, except to the extent such restrictions are prohibited by applicable law.

4. User Content

"User Content" means any content, material, or information that a user creates, uploads, posts, submits, transmits, shares, stores, displays, or otherwise makes available through the Service, including text, images, profile information, comments, messages, reports, reviews, listings, and other materials.

You retain ownership of your User Content. By submitting User Content, you grant Foryn a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, adapt, modify, publish, display, distribute, translate, remove, restrict, and otherwise use your User Content as necessary to operate, provide, improve, promote, protect, and moderate the Service and to enforce this Agreement.

You represent and warrant that you own or have all rights necessary to submit your User Content and to grant the license above, and that your User Content does not violate this Agreement, any law, or any third-party rights.

5. No Tolerance for Objectionable Content or Abusive Users

Foryn has no tolerance for objectionable content or abusive users. You may not post, upload, share, transmit, promote, request, encourage, facilitate, or otherwise make available any content or behavior that is illegal, harmful, abusive, offensive, unsafe, discriminatory, disturbing, or inconsistent with this Agreement.

5.1 Strictly Prohibited Content and Conduct

The following are strictly prohibited:

• Sexual or pornographic content: pornography, sexually explicit content, nudity, sexual solicitation, sexual services, adult sexual roleplay, non-consensual sexual content, or sexualized content involving minors.
• Disturbing, disgusting, or offensive content: content intended to shock, disgust, degrade, humiliate, frighten, or cause substantial discomfort; graphic violence; gore; cruelty; or content in exceptionally poor taste.
• Harassment and abuse: bullying, stalking, threats, intimidation, doxxing, blackmail, humiliation, unwanted sexual attention, impersonation, coordinated abuse, or repeated unwanted contact.
• Hate and discrimination: hate speech, slurs, dehumanizing content, or discriminatory content based on race, color, ethnicity, nationality, religion, sex, gender, gender identity, sexual orientation, disability, age, political belief, political affiliation, veteran status, caste, or any protected or sensitive characteristic.
• Political discrimination and extremist content: content that promotes political hatred, targeted political discrimination, political intimidation, violent extremism, terrorism, or violence against people because of political beliefs or affiliations.
• Gambling: gambling, betting, casino games for money, lotteries, wagering, odds selling, gambling promotions, or instructions for unlawful gambling.
• Drugs and controlled substances: sale, promotion, procurement, instructions, or encouragement involving illegal drugs, controlled substances, drug abuse, drug paraphernalia, or misuse of regulated substances.
• Self-harm or harm to others: encouragement, instructions, or promotion of suicide, self-harm, violence, physical threats, exploitation, or harm to any person or group.
• Minors and exploitation: any content that exploits, sexualizes, harms, identifies, bullies, or endangers minors, even though Foryn is intended only for users 18 or older.
• Illegal activity: fraud, scams, phishing, malware, unauthorized access, identity theft, money laundering, illegal goods, illegal services, or attempts to evade law enforcement.
• Intellectual property violations: content that infringes copyrights, trademarks, trade secrets, privacy rights, publicity rights, or other rights.
• Spam and manipulation: spam, fake engagement, deceptive links, misleading metadata, bots, scraping, automated account creation, or attempts to manipulate ranking, moderation, or security systems.
• Unsafe commercial activity: unauthorized advertising, deceptive promotions, sale of regulated goods, or transactions not permitted by law or this Agreement.

5.2 Moderation and Enforcement

We may, but are not required to, monitor, screen, filter, review, restrict, remove, disable, or refuse any User Content at any time. We may use automated tools, manual review, user reports, safety signals, account history, keyword filters, image review, rate limits, and other measures to reduce objectionable material and abusive conduct.

If we determine that you violated this Agreement or created risk to Foryn, users, third parties, or the public, we may take action without prior notice, including removing content, limiting visibility, disabling features, issuing warnings, suspending your account, terminating your account, blocking access, preserving evidence, notifying affected users, or reporting to law enforcement or regulators where appropriate.

We may consider context, severity, repetition, intent, user history, legal obligations, and risk to users when deciding enforcement actions. We may also remove content or restrict accounts to comply with App Store rules, legal obligations, or safety requirements.

6. Reporting Objectionable Content and Blocking Users

Foryn provides or may provide ways to report objectionable content and abusive users. You may report content or behavior through in-app reporting tools where available or by emailing foryn@forynshop.com. Please include enough information for us to review the report, such as usernames, links, screenshots, dates, descriptions, and the reason for the report.

Where user interaction features are available, Foryn provides or may provide the ability to block abusive users. Blocking may limit interactions, messages, profile visibility, or other contact, depending on the feature.

We aim to review reports in a timely manner and prioritize reports involving sexual content, threats, harassment, illegal activity, minors, self-harm, terrorism, violent extremism, hate, discrimination, political discrimination, gambling, drugs, or other high-risk content. Submitting false, malicious, or abusive reports may itself violate this Agreement.

7. Additional Rules for Safe Use

• You may not use the Service to harm, exploit, mislead, or manipulate another person.
• You may not use the Service for any illegal, unsafe, deceptive, discriminatory, offensive, or abusive purpose.
• You may not interfere with or disrupt the Service, servers, networks, security systems, moderation systems, or other users' experience.
• You may not access the Service using unauthorized scripts, bots, scrapers, crawlers, or automated tools.
• You may not attempt to bypass age restrictions, content filters, reporting tools, blocking tools, rate limits, account restrictions, or enforcement measures.
• You may not collect, publish, or misuse another person's personal information without authorization.
• You may not represent that your content or opinions are endorsed by Foryn unless we expressly authorize it in writing.

8. In-App Purchases, Subscriptions, and App Store Rules

Foryn may offer paid digital content, premium features, subscriptions, or other in-app purchases. All purchases of digital content or digital services made inside the app must be completed through Apple's in-app purchase system, unless Apple rules allow another method.

Before you complete an in-app purchase, the App Store purchase screen will show important purchase information, which may include the product name, price, subscription period, renewal terms, billing frequency, free trial terms if any, and confirmation that payment will be charged to your Apple ID. You are responsible for reviewing the purchase information before confirming payment.

If a subscription is offered, it may automatically renew unless canceled at least 24 hours before the end of the current subscription period or as otherwise stated by Apple. Your Apple ID may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings. Refund requests are handled by Apple according to Apple's policies. Foryn cannot guarantee that Apple will approve a refund.

Paid features may be unavailable, interrupted, modified, or discontinued where permitted by law. If we materially change paid features, we will handle active purchases and subscriptions in accordance with applicable law and App Store rules.

9. App Tracking Transparency and Privacy Choices

Foryn's Privacy Policy explains how information is collected and used. If Foryn seeks to track your activity across other companies' apps or websites for advertising, advertising measurement, or similar purposes, Foryn will request permission through Apple's App Tracking Transparency framework where required. The App Tracking Transparency description may state: "Foryn would like permission to track your activity across other companies' apps and websites to personalize ads, measure advertising performance, and improve the Service."

You may allow or deny tracking, and you may change your choice in your device settings. Your agreement to this Agreement does not replace any separate consent required for tracking, marketing, cookies, or other privacy choices under applicable law or platform rules.

10. Third-Party Services and External Links

The Service may contain or rely on third-party services, websites, content, software, analytics, hosting, App Store services, payment entitlement services, or other resources. Foryn is not responsible for third-party services, and your use of them may be governed by separate terms and privacy policies. You use third-party services at your own risk, except where prohibited by applicable law.

11. Feedback

If you provide ideas, suggestions, feedback, bug reports, or recommendations, you grant Foryn a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, unless prohibited by applicable law.

12. Copyright and Intellectual Property Complaints

If you believe content on Foryn infringes your copyright, trademark, privacy, publicity, or other rights, contact us at foryn@forynshop.com. Include your name, contact information, a description of the content, the location of the content, the rights you claim are infringed, and a statement that you have a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law.

We may remove or restrict content alleged to infringe rights and may terminate repeat infringers where appropriate.

13. Support and Maintenance

Foryn is responsible for providing support and maintenance for the Service only as described in this Agreement or as required by applicable law. Apple has no obligation to provide maintenance or support for Foryn. For support, contact foryn@forynshop.com.

14. Product Claims

Foryn, not Apple, is responsible for addressing claims relating to the Service or your possession or use of the app, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws, except to the extent otherwise required by applicable law.

15. Intellectual Property Claims Involving the App

If a third party claims that the Foryn app or your possession and use of the app infringes that third party's intellectual property rights, Foryn, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim, to the extent required by this Agreement and applicable law.

16. Termination

You may stop using Foryn at any time. We may suspend or terminate your access to the Service at any time if we believe you violated this Agreement, created risk or possible legal exposure, abused other users, posted objectionable content, misused the Service, infringed rights, or engaged in unlawful or unsafe conduct.

Upon termination, the license granted to you ends immediately, and you must stop using the app and Service. Sections that by their nature should survive termination will survive, including ownership, User Content licenses, safety enforcement records, disclaimers, limitations of liability, indemnity, dispute terms, and Apple-related terms.

17. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. Foryn disclaims all warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, availability, reliability, security, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, secure, free of objectionable content, or available at any particular time or location. We do not guarantee that moderation systems will detect all violations or that all User Content will be accurate, lawful, or appropriate.

Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Foryn and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenues, lost data, loss of goodwill, service interruption, device damage, or the cost of substitute services, arising out of or related to the Service or this Agreement.

To the maximum extent permitted by applicable law, Foryn's total liability for any claim arising out of or related to the Service or this Agreement will not exceed the greater of the amount you paid to Foryn through the Service during the three months before the event giving rise to the claim or USD $50.

Nothing in this Agreement limits liability that cannot be limited under applicable law.

19. Indemnity

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Foryn and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your use of the Service, your violation of this Agreement, your violation of law, or your violation of third-party rights.

20. Export Compliance and Sanctions

You may not use, export, re-export, import, or transfer the app or Service except as authorized by United States law, the laws of the jurisdiction where you obtained the app, and any other applicable laws. You represent and warrant that you are not located in a country or region subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited or restricted parties. You may not use the Service for purposes prohibited by U.S. law or other applicable law.

21. U.S. Government End Users

The app and related documentation are "Commercial Items" as defined under applicable U.S. federal acquisition rules and are licensed to U.S. government end users only with the rights granted to all other end users under this Agreement.

22. Apple Terms and Apple as Third-Party Beneficiary

You and Foryn acknowledge that this Agreement is between you and Foryn only, not Apple. Apple is not responsible for the Service or User Content. Apple has no obligation to provide support or maintenance for Foryn.

You must also comply with applicable Apple Media Services Terms and Conditions and App Store rules when using Foryn. If any term of this Agreement conflicts with applicable Apple terms required for App Store distribution, the applicable Apple requirement will control to the extent of the conflict.

Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right, and will be deemed to have accepted the right, to enforce this Agreement against you as a third-party beneficiary.

23. Changes to the Service or Agreement

We may modify, suspend, or discontinue any part of the Service at any time, subject to applicable law and App Store rules. We may update this Agreement from time to time. If we make material changes, we may notify you through the Service, by email, or by other reasonable means. The "Last Updated" date shows when this Agreement was last modified. Your continued use of the Service after an updated Agreement becomes effective means you accept the updated Agreement.

24. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the jurisdiction selected by Foryn, without regard to conflict of law principles, except where applicable consumer protection laws require a different governing law or forum. If you reside in the European Union, United Kingdom, Switzerland, Norway, Iceland, or another jurisdiction with mandatory consumer rights, nothing in this Agreement limits rights you cannot waive under local law.

Before filing a formal claim, you agree to contact us at foryn@forynshop.com and attempt to resolve the issue informally. This informal process does not prevent either party from seeking urgent relief where necessary.

25. Miscellaneous

This Agreement is the entire agreement between you and Foryn regarding the Service, except for additional terms that apply to specific features or purchases. If any part of this Agreement is found unenforceable, the remaining parts will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign this Agreement without our consent. We may assign this Agreement in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
